In accordance with the Law No. 6698 on the Protection of Personal Data (KVKK), it is important to process and store personal data properly. Therefore, as iqonhom.com.tr (hereinafter referred to as “iqon”), we exercise due care to take the technical and administrative measures required by law to protect, store, and process your personal data and/or special categories of personal data.

We frequently collect personal data via the internet. Personal data and/or special categories of personal data obtained and recorded during visits to our website are processed in accordance with the Law on the Protection of Personal Data. In this context, iqon, acting as the data controller, collects and stores your data within legal limits. 1. WhaT Is PeRsoNal DaTa?

Personal data is defined in Law No. 6698 as “Any information relating to an identified or identifiable natural person.” As understood from the definition, any data that makes you identifiable is personal data. In this context, your personal data cannot be obtained or processed by another party without your explicit consent. In addition, political opinion, sect, race, religion, membership in associations or foundations, health information, philosophical belief, faith, sexual preference, criminal record, criminal conviction information, and biometric data are considered special categories of personal data. In order to collect, transfer, or process your special categories of personal data, your separate and explicit WRITTEN consent is required. All explanations and information provided in this clarification text regarding your personal data also cover your special categories of personal data.

2. Legal BasIs

Law No. 6698 stipulates that individuals whose data is processed must be clearly and explicitly informed about the data collected while obtaining their consent. This obligation, referred to as the Obligation to Inform, is regulated under Article 10 of the Law as follows: “During the collection of personal data, the data controller or the person authorized by it shall inform the data subjects about the identity of the data controller and its representative, if any; the purpose for which personal data will be processed; to whom and for what purpose the processed personal data may be transferred; the method and legal basis of data collection; and the other rights listed under Article 11.”

Article 3 of the Law defines the data controller as “the natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.” In this context, the data controller is https://www.iqonhom.com.

3. Scope of The DaTa CoNtRolleR’s OblIgaTIoN To INfoRM

In accordance with the provisions explained above, the data controller is iqonhom.com. Under this title, iqon informs data subjects that personal data and/or special categories of personal data are processed within the limits prescribed by law and in compliance with the law.

Law No. 6698 on the Protection of Personal Data states that in certain cases explicit consent is not required for the processing and storage of data. These cases, specified in paragraph 2 of Article 5 of the Law, are as follows;

  • Where it is explicitly provided for by law.
  • Where it is necessary to protect the life or physical integrity of a person who is unable to express consent due to actual impossibility or whose consent is not legally valid.
  • Where it is necessary to process personal data of the parties to a contract, provided that it is directly related to the establishment or performance of the contract.
  • Where it is necessary for the data controller to fulfill its legal obligation.
  • Where the data has been made public by the data subject.
  • Where data processing is necessary for the establishment, exercise, or protection of a right.
  • Where data processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
  • In the presence of these conditions, iqon has the right to process data without your explicit consent.

7. MeThod of CollecTINg YouR PeRsoNal DaTa BY OuR CoMpaNY

Under developing and changing technological conditions, our Company collects data through various channels. The method of collecting such data varies. Without limitation, our data collection methods include the website, social media platforms, instant messaging tools, emails, telephone, fax, manual methods, contracts, all documents submitted to our Company for the performance of services, and mobile applications. 8. TRaNsfeR aNd PRoTecTIoN of DaTa

Your data is transferred in accordance with Law No. 6698 and the conditions set forth in our confidentiality agreement solely for the purpose of fulfilling the service. iqon exercises utmost care during the transfer process and strives to transfer the minimum amount of personal data possible. In this context, iqon transfers data to its solution partners and service providers.

b-ProTecTIoN

The primary purpose of Law No. 6698 is to ensure the protection of data and prevent unauthorized transfers. In order to prevent data from being transferred to unauthorized third parties, iqon takes all necessary technical and administrative measures. In this context, we align our internal policies with the Law and maintain all necessary technical software and hardware for the protection of personal data. We also strive to prevent both our employees and third parties we work with from acting contrary to our Privacy Policy.

9. RIghTs of The DaTa SubjecT

a- GeNeRal INfoRMaTIoN AboUT The RIghT of ApplIcaTIoN

Article 11 of Law No. 6698 on the Protection of Personal Data regulates the rights of the data subject. Pursuant to this article, your rights as a data subject are as follows:

  • To learn whether your personal data is processed,
  • To request information if your personal data has been processed,
  • To learn the purpose of processing personal data and whether they are used in accordance with that purpose,
  • To know the third parties to whom personal data is transferred domestically or abroad,
  • To request correction of personal data if it is incomplete or incorrectly processed,
  • To request deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law titled “Deletion, Destruction or Anonymization of Personal Data”,
  • To request notification to third parties to whom personal data has been transferred regarding the correction, deletion, or destruction of data,
  • To object to the occurrence of a result against the person by analyzing processed data exclusively through automated systems,
  • To request compensation for damages in case of unlawful processing of personal data.

You may submit your requests regarding your rights arising from the Law on the Protection of Personal Data to our Company in accordance with the procedure specified in this Clarification Text. Your requests will be answered by iqon within thirty days at the latest. Applications must be made personally by the data subject. iqon will only consider applications submitted by the data subject and will share information only with the applicant. Although applications are free of charge, if a fee is determined by the Personal Data Protection Board, the fee set by the Board may be charged to you by our Company.

You may access the required application form on our website.
